D800 commerical video

On Nikon's USA web site it says this about the D800: "For cinematographers and multimedia professionals, 36.3 MP means true 1080p HD cinematic quality video" but in the user manual it says this: "THIS PRODUCT IS LICENSED UNDER THE AVC PATENT PORTFOLIO LICENSE FOR THE PERSONAL AND NON-COMMERCIAL USE OF A CONSUMER...NO LICENSE IS GRANTED OR SHALL BE IMPLIED FOR ANY OTHER USE."

I'm confused about this. I intended to use the video capability professionally/commercially. Does this mean I have to buy some kind of commercial use license from somewhere? I've read that the D800 is being used for commercial video production in the US. Are all these users violating the terms of their license?
