No, changing the Custom Settings bank to 'D' is the solution. This has already been acknowledged by Nikon as a fix for the bug of not being able to access the Mirror Lock Up and the Dust Off Ref photo items. I also got confirmation from the author David Busch on this matter.
I've owned a D200 and a D700 and neither one of these cameras exhibited the problem.
When I first got my D800E I was able to access these menu items from all of the banks. After 6-months and loads of setting alterations to all of the banks - both Shooting and Custom Settings - the access problem occurred. And then there were also those firmware updates during this time period which may or may not have had an impact. If some users are not experiencing this bug it may be because they have not changed whatever settings that are causing it.
