The problem is Nikon have initially taken the view the damage has been caused by an external source and not an internal mechanical shutter fault. If Nikon are wrong this can only be determined by getting your complaint escalated and a re examination of the shutter mechanism.
Photography is a bit like archery. A technically better camera, lens or arrow may not hit the target as often as it could if the photographer or archer does not practice enough.
