Did you try doing a calibration run on it? I would certainly try that if not.
(Skip if you already know about li-ion batteries) - The battery has essentially a computer in it, and that computer needs calibration to know what empty and full look like. The computer also plays a role in telling the charger when to stop charging (this is all one reason why cheap li-ion batteries sometimes melt down, bad chips permit overcharging). The calibration is a remedy if that's it. It could also be a bad chip or battery.
I can understand why no one warranties batteries, consider how usage, third party chargers, etc. may play a role. But hopefully they will do the right thing if it's that clearly bad (and it is clearly new-ish).
