Glen,

I just checked my D3 and if it's set for spot metering, the spot icon shows up in the view finder.

Have you taken any test photos with the camera to determine what the EXIF indicates?

If you have a warranty, I'd ask the shop for help. The meter should not change on its own after you've set it.

BTW, is the switch on the view finder loose? You have to press the center of the switch to move it from one position to the other.
