How long is too long to wait for a B & H delivery?

Hi Guys,
I ordered a Gnarbox XQD reader from B & H Photo back in Feb 2021.
I have had about ten emails since then, from B&H, telling me it is not in stock.

I have contacted Gnarbox directly and they first said April, then June and then gave me all manner of excuses as to why they have not got their act together and produced this item.

Can anyone advise me if there is a statute in the USA, when they no longer have to return my money. For example outside of a calendar year?
I have asked B&H to return my money but they just say, when it is in stock they will ship it!
