There is no difference between the focus issues on the D800 or D800E.

I have the D800E with the issue with the left focus point. The rest of the focus points work fine and it is by far the sharpest camera I have ever used. I'll probably send it for repair before the warranty ends, but I'm in no real rush and don't want to create any new issues.

The reports are the current production models are fine.

Certainly in the early days both the D800 and the D800E were (are still?) prone to focus errors. I have a D800 from May that I've sent to Nikon twice (they fixed the AF the first go-round, but I think they knocked the focus screen out of alignment because it was way off--like, several feet off--which wasn't a problem out-of-the-box. I haven't had a chance to test the camera after repair #2).

I also had and returned a D800E in June or July that had the issue, as I didn't want to deal with sending that in for "repair roulette" as well.

In October, I got another D800E and this one focuses perfectly, AF and MF, so it was worth the wait. Now, that's a sample size of 3, so my only suggestion would be to try before you buy, or buy from a dealer who will let you return or exchange your camera if it proves to be defective.
