Actually your interpretation of what is happening is incorrect.
When you are in live view mode the viewing aperture will stay at that aperture before you take the photo even if you change the aperture. This is true. When live view is on the aperture will stay the same until you take the photo with a new aperture setting. At that time the aperture will change to the new setting and the photo will be taken with the new aperture setting. This has not changed with the new firmware.
Re-read the review and the last sentence in the paragraph where they mention the quirk. This is what they say.
"It will honour the set aperture when actually making an exposure, and indeed return to live view at that aperture afterwards...."
I have verified that this is what actually happens on my D5100.
